Life circumstances can change long after purchasing a Mexico timeshare or vacation-club membership. Illness, disability, retirement, reduced income, job loss, divorce or the death of a spouse can make the continuing payments and maintenance fees financially impossible.

A hardship does not automatically cancel the agreement. However, clearly documenting what changed, how it affects the owner and why the membership can no longer be used or afforded can strengthen a properly prepared cancellation request.

Mexico vacation-club agreements are not all structured the same. Before deciding what action to take, the owner should identify the companies responsible for the membership, financing and payment collection, along with the agreement’s governing jurisdiction and provisions concerning default or termination.

Common Hardship Situations

A hardship cancellation request should explain exactly what has changed since the membership was purchased and why continuing the obligation is no longer reasonable or financially possible. Common hardships include:

  • Inability to travel because of medical limitations

  • Retirement or a substantial reduction in income

If the resort refuses certified mail or does not respond, Wayne’s process does not depend solely on receiving an acknowledgment from the resort. The cancellation notices may also be sent through other documented channels and to additional companies connected with the membership.

Collection Concerns

Owners should preserve every letter, email, account statement and collection notice. They should not provide new banking information, agree to a payment arrangement or sign additional documents without first understanding who is making the request and how it relates to the original agreement.
