If you own a Vidanta membership and want out, here’s what you need to know before you start.
It’s Not a Timeshare — It’s a Vacation Club Membership
Despite how it’s marketed, a Vidanta membership isn’t a deeded timeshare. It’s a vacation club membership, and like most Mexico vacation club products, it’s typically listed with one of the two largest exchange networks, RCI or Interval International. You’re not buying real property. You’re buying access rights within a membership system.
They Usually Don’t Own the Rooms
Vidanta owns and operates its own resorts, which is actually less common in the Mexico vacation club world. Even so, availability for members can be limited because a portion of resort inventory is set aside for the general public and for prospective buyers touring the property, since that inventory is what fuels the ongoing sales pipeline.
Mexican Jurisdiction — What It Means for You
Your Vidanta contract falls under Mexican law and Mexican jurisdiction. That jurisdiction doesn’t extend into the U.S., Canada, or any other country. A Mexican company has no legal standing to sue you in a U.S. or Canadian court.
The 5-Day Rescission Period
Mexico gives you a 5-day cooling-off period after purchase, during which you can cancel your membership. Resorts rarely bring this up on their own.
During those 5 days, expect the resort to try hard to keep you in the deal — additional gifts, a free room at the resort, excursions, or dinner coupons are common tactics to keep you engaged and away from cancelling.
Here’s the catch buried in the paperwork: if you cancel during the rescission period after using any of those gifts, you can be held liable for rack rate charges or the full cost of each gift you used. And because most buyers are on vacation when they sign, reading the full contract carefully isn’t usually top of mind. By the time you’re home and have had a chance to review everything, the 5-day window has often already closed.
After the Cooling-Off Period
If your 5 days have passed and you want to cancel — often after reading reviews or learning more about the resort once the vacation excitement wears off — the rescission period no longer applies. At this point, cancelling requires the legal route, not a simple cancellation notice.
This is where experience matters. Someone who specifically knows the Mexico vacation club market and the legal route required at this stage can make the difference, because resorts commonly attempt to collect on any unpaid balance through companies set up in the U.S., and may attempt to damage your credit even though doing so is illegal.
Why You Need Someone Who Knows the System
Most Vidanta members are Americans, Canadians, or other foreign nationals who have no experience with how Mexican companies or Mexican law operate. Trying to cancel without that knowledge is where most owners get stuck, or get talked into paying an exit company thousands of dollars for something they could have done themselves.
Yes, You Can Cancel — Paid Off or Not
Whether your Vidanta membership is fully paid off or still has a balance, you can cancel. The process differs depending on where you are in the rescission window, but cancellation is always possible.
